The Government has another legal battle on its hands.
Michael Witbrock is taking Immigration Minister Kris Faafoi and MBIE to court over his Chinese husband's Visa application being suspended, one they applied for in November 2019.
The Government has said any applications before the border was shut can now continue to be processed, but not decided on.
Lawyer Pooja Sundar told Mike Hosking the decision to suspend applications was unlawful.
“He failed to consider the international obligations that New Zealand has signed up to, so things like family unity, care of the child, the best interests of the child.”
