The fight to clear Peter Ellis' name goes to the Supreme Court today.
The 61-year-old served seven years in prison for sexually abusing children at the Christchurch Civic Creche in the 90s, but always maintained his innocence.
He died in August still fighting to clear his name.
Lawyer Nigel Hampton QC told Mike Hosking today's hearing will focus on whether the Supreme Court has jurisdiction for an appeal to proceed.
"The Supreme Court will hear arguments for and against the case going ahead."
