The Government has patented the silver fern as a global trade mark for Kiwi made products.
Eligible exporters can now apply for a license to use the FernMark.
Rebecca Smith, Director of New Zealand Story, says the mark will give companies a competitive advantage overseas.
"It's a well recognised symbol, and it gives consumers overseas assurance that the products that they buy come from New Zealand."
But if the symbol is selected to be on our new flag the government won't be able to keep the trade mark.
Rebecca Smith said if the fern does end up on the flag they will carry on with the licensing programme.
"International law doesn't permit you to trademark any aspect of the flag. However, you are allow to continue to use the national symbol in a license programme."
