The Supreme Court is allowing an appeal to be heard for two Chinese children facing deportation for their father's drug trafficking.
In 2008, Jianyong Guo was jailed for five years and three months for importing, and possessing for supply, a large amount of pseudoephedrine.
Pseudoephedrine is a highly sought after precursor in the manufacturing of methamphetamine, otherwise known as P.Â
Guo and his two children faced deportation under the Immigration Act - their mother returned to China in 2013 on her own accord.
The father has been trying to appeal his deportation on humanitarian grounds - all rejected by the High Court, Court of Appeal and now the Supreme Court.
However, the Supreme Court is allowing his 24 year old daughter, Jiaxi Guo and nine year old son, Jiaming Guo to try again in the Court of Appeal.
Its ruling states Jiaxi Guo is like a 'second mother' to her younger siblings and it is an unusual possibility the children could live in New Zealand without their parents.
