A lawsuit over bank fees is set to continue, despite a similar case being overturned in Australia.
The Federal Court in Australia ruled ANZ's credit card fees were unlawful and ordered the bank to reimburse customers, but ANZ has appealed, and won.
Lawyer Andrew Hooker is leading class action against banks in New Zealand over their fees and says the case has been on hold, pending the outcome of the Australian case.
"Now that a decision has come out the matter will be referred back to a judge for timetabling, and the cases will proceed according to that timetable."
He's still working through the decision but says it shouldn't hurt the case here.
"The case in Australia's not binding in New Zealand and there are many aspects in which the case is different to New Zealand, so no it doesn't change anything."
